Here's the state of play globally for crypto regulation and enforcement in 2023 — and a look at what to expect in 2024. "However, much of their work has involved providing guidance to the industry through enforcement actions," continued Levin. Crypto market participants nevertheless hope that the spate of legal challenges brought to crypto companies in 2023 will bring clarity in the form of new regulations. The U.S.'s dominant role in global finance and its focus on consumer protection plays a crucial role in its leading position in crypto regulation enforcement. The region has been increasingly warming to crypto assets, despite a broader anti-crypto push from China, which banned bitcoin trading and mining in 2021.

REUTERS/Jane Rosenberg Acquire Licensing RightsNEW YORK, Nov 2 (Reuters Breakingviews) - Just over a year ago, Sam Bankman-Fried might have been counting his large stash of virtual coins. A Manhattan jury on Thursday convicted the FTX founder of seven counts related to crimes he committed at the helm of the now-bankrupt cryptocurrency exchange. With some $8 billion in customer funds stolen, his misdeeds will go down as one of the biggest financial frauds on record. To be sure, the speculative bubble in crypto would probably have deflated even without Bankman-Fried. The bankrupt exchange is also negotiating with three bidders to help it relaunch trading services, Bloomberg reported last month.

Crypto lender BlockFi begins post-bankruptcy wind-down

FILE PHOTO; Figurines with smartphones and computers are seen in front of the BlockFi logo in this illustration, November 28, 2022. BlockFi estimated in court filings that customers who had interest-bearing Earn accounts will receive between 39.4% and 100% of the value in their accounts. In its bankruptcy filing in November 2022, BlockFi had cited its loans to FTX's sister firm Alameda as one of the reasons for its collapse. Those with BlockFi Interest Accounts and Retail Loans will be repaid over the coming months, but the amounts they receive could vary based on the outcome of the FTX bankruptcy, BlockFi said. Crypto lenders, the de facto banks of the crypto world, boomed during the pandemic, attracting retail customers with double-digit rates in return for their crypto deposits.

Through the lawsuit, Attorney General James is seeking restitution for investors and "disgorgement of ill-gotten gains," along with a ban on all the three cryptocurrency firms from the financial investment industry in New York. At the heart of the lawsuit is a program that Gemini ran in partnership with Genesis, dubbed "Gemini Earn". Gemini did not reveal any of this information to the investors of Gemini Earn, she added. Genesis and Gemini have clashed several times over the past few months, including over Gemini Earn. DCG said it was blindsided by the attorney general's complaint and the company's CEO Barry Silbert said the lawsuit had "baseless allegations".

Crypto firms Digital Currency Group and Gemini defrauded more than 230,000 investors out of a collective $1.1 billion, New York state prosecutors said in a lawsuit filed in Manhattan Thursday. They cited a series of missteps, including failure to adequately manage the risk associated with exposure to Sam Bankman-Fried's bankrupt and allegedly fraudulent crypto trading firm. For a time, it was very lucrative, until crypto hedge fund Three Arrows Capital defaulted on its loans and sent much of the crypto world into tumult. Gemini would then give Genesis that customer crypto for further lending, collecting a slice of Genesis' interest. By extension, prosecutors say, that meant that Gemini also had exposure to Alameda — and allegedly knew they did.

Authorities have arrested crypto fugitive Su Zhu, co-founder of bankrupt digital asset hedge fund Three Arrows Capital, who was apparently attempting to flee Singapore. Zhu and co-founder Kyle Davies have both been sentenced to four months in prison, according to Teneo, the financial advisory firm handling 3AC's liquidation. The Singapore Courts ruled against Zhu for deliberately failing to comply with court orders compelling him to cooperate with Teneo's investigation into creditors' claims and the implosion of the multibillion-dollar fund. At its peak in 2022, 3AC managed about $10 billion in assets, making it one of the most prominent crypto hedge funds in the world. The firm added that it may seek further court orders against him.

Sept 29 (Reuters) - Su Zhu, one of the founders of bankrupt crypto hedge fund Three Arrows Capital, has been "apprehended" at Changi Airport in Singapore, the company's liquidators Teneo said in an email on Friday. Zhu will spend four months in prison under an arrest order granted by Singapore courts in September 2023 after he did not comply with an order to cooperate with investigations into Three Arrows Capital, which filed for bankruptcy last year, Teneo said. A similar order has also been granted for fellow co-founder, Kyle Davies, but his "whereabouts remain unknown at this point in time," Teneo said. Three Arrows Capital was one of the first high-profile cryptocurrency firms to collapse in 2022, filing for bankruptcy in July of last year after it was hit by a sharp sell-off in crypto markets. While breezy bitcoin has bounced back, leaping by about 55% this year, investments in crypto startups have dropped for the fifth straight quarter. VC crypto bets totaled just under $2.3 billion in April-July this year, the lowest quarterly level for over three years, according to data firm PitchBook. In the first half of 2023, investments were down by almost three-quarters from a year ago to $5 billion. Those that are raising capital now are probably doing it because they have to," said Adam Reeds, CEO of Toronto-based crypto finance company Ledn. VC crypto investments have correlated with crypto asset prices with a lag of roughly three to six months, according to PitchBook, and if current trends continue, VC investment would rise during the second half of 2023.

DCG and Silbert, who is also a defendant, called Gemini a "sophisticated market participant" that had told Gemini Earn customers, who were expecting high interest rates, that it had "thoroughly vetted" Genesis. Gemini said the defendants did this so that Gemini Earn customers would continue lending crypto assets to Genesis, believing it was "business as usual." Gemini and Genesis are defendants in a U.S. Securities and Exchange Commission civil lawsuit claiming they bypassed disclosure requirements meant to protect investors in connection with Gemini Earn. Coinbase released its second quarter earnings for 2023 — and the report shows a crypto contraction. A prolonged Crypto Winter, plus an SEC lawsuit, could mean trouble for the industry. Transaction volume for consumers and institutions is down 70% and 54%, respectively, when compared to the second quarter of 2022. While some have said that 2022's Crypto Winter is finally over, hurdles remain. Coinbase moved to dismiss the suit earlier this month, but with the controversy continuing, it doesn't look like the Crypto Winter will fully thaw anytime soon.

July 13 (Reuters) - Alex Mashinsky, the founder and former CEO of bankrupt cryptocurrency lender Celsius Network, was arrested and charged with fraud, a U.S. prosecutor in New York said Thursday, while three federal regulatory agencies sued him and his company. Mashinsky, 57, was charged with seven criminal counts - including securities fraud, commodities fraud and wire fraud - while Celsius' former chief revenue officer, Roni Cohen-Pavon, was charged with four criminal counts, according to the indictment, which was unsealed on Thursday. Its founder Sam Bankman-Fried was charged with fraud last year, and has pleaded not guilty. Crypto lenders such as Celsius grew rapidly as crypto prices surged during the COVID-19 pandemic. The impact of artificial intelligence on Wall Street has plenty of people concerned, but some financial advisors fear a much more sinister opponent. Financial advisors are right to be concerned. A 2022 survey found Gen Z was more likely to seek out financial advice from TikTok (34%) and YouTube (33%) than a financial advisor (24%). Couple that with their often obsessive consumption of social media, and you start to see why financial advisors never had a fighting chance. More on why advisors are worried about young people turning to TikTok for help with their finances.

When hedge fund Three Arrows Capital collapsed last year, it left the crypto world reeling. But the firm's founders, Kyle Davies and Su Zhu, have reportedly had it pretty good ever since. Just because your crypto firm collapsed, doesn't mean you are going to end up on house arrest at your parents' pad. As the liquidation process began for their crypto firm, both founders flew to Bali — Indonesia notably doesn't have an extradition treaty with the United States — the Times reported. According to the Times, Zhu started to hang out with surfers and UFC fighters.
